Research on Complex Cases

Magnus is generally only hired on difficult cases.  Yet, some cases are more difficult, or complex, than others.  The complex cases on which Magnus works often have multiple parties, numerous issues (counts in the complaint), unique issues, high profile or celebrity litigants, long time frames, and potentially “break the company” outcomes.  

Magnus custom designs research methodologies to fit the needs of case.  On complex matters, Magnus’ Trial Consultants often design research methodologies combining Issue Evaluation methodologies, such a jury focus group, followed by more traditional mock trial research to evaluate the case issues in an adversarial proceeding.  Just as multiple medical tests (X-rays, CT scans, MRIs) may be required for a medical diagnosis, multiple methodologies provide for an optimal evaluation of all aspects of complex cases.

The methodologies Magnus’ Trial Consultants employ for complex cases typically involve two or more phases of research. The first methodology explores the issues in a neutral fashion (for example, a Jury Focus Group or a Case Analysis Survey) and subsequent methods are used to explore liability and damages (for example, Case Strength Evaluation Research or Mock Trial research.)  Witness evaluation is often a part of the process, as well.  

The data collected in all phases are analyzed across methodologies.  The combined data set is evaluated via various statistical techniques to refine case strategies, and, to develop juror profiles for jury selection.  There is strength in numbers.  With more participants or mock jurors and more decision points (individual survey responses or mock trial group verdicts) come better research results leading to better case strategies, decisions, and ultimately, outcomes. 

Magnus’ trial consultants are sometimes involved in complex cases for several years prior to trial. The trial consultant works with the trial team to initially dissect the case issues in order to craft the best case approach for mediation or trial. To maximize the outcome for the client, it is always important to involve Magnus early, especially in complex matters, to enable the findings from mock trial or other research, and the related recommendations, to be implemented.
